1. Introduction
The website spraia.app and the mobile app SPRAIA are published by the publisher identified in the legal notice.
2. Purpose
These Terms of Service (the "Terms") govern access to and use of the spraia.app website and the SPRAIA mobile app (the "Services").
3. Acceptance of the Terms
Using the Services means full acceptance of these Terms. If you do not accept them, please do not use our Services.
The publisher reserves the right to modify these Terms at any time. Users will be informed of any material change. Continued use after a change means acceptance of the new Terms.
4. Description of the Services
SPRAIA is a mobile app for managing indoor plants using artificial intelligence. It notably offers:
- Plant identification from photos
- Diagnosis of diseases and problems
- Personalised care advice
- Watering and maintenance reminders
5. Registration and user account
Use of some SPRAIA features requires creating an account. The user undertakes to:
- Provide accurate and up-to-date information
- Keep login credentials confidential
- Immediately notify any unauthorised use of their account
The user is solely responsible for activity on their account.
6. Subscriptions
SPRAIA offers a free version and a "SPRAIA Pro" premium subscription. Pricing and subscription terms will be communicated at launch.
Billing and subscription management is handled by the App Store (Apple) or the Google Play Store (Google) depending on the platform used. Refund and termination conditions are those applied by these platforms.
7. Intellectual property
SPRAIA, its logo, its content (text, images, algorithms, source code) and all elements composing the Services are protected by intellectual property law.
Any unauthorised reproduction, representation, modification or exploitation, even partial, is prohibited and constitutes counterfeiting punishable under the French Intellectual Property Code.
8. Limitation of liability
Advice provided by SPRAIA is generated by artificial-intelligence algorithms and botanical databases. It is given for informational purposes and cannot replace professional advice (botanist, landscape designer, gardener).
The publisher cannot be held liable for:
- Direct or indirect damages resulting from use of the Services
- Inaccuracy or incompleteness of advice provided by the AI
- Any temporary interruption of the Services for maintenance or update
- Data loss in case of force majeure
9. User obligations
The user undertakes to:
- Use the Services in accordance with their intended purpose
- Not attempt to bypass security measures
- Not use the Services for unlawful purposes or contrary to these Terms
- Respect intellectual property rights
10. Applicable law and disputes
These Terms are governed by French law. In case of dispute, an amicable solution will be sought first. Failing that, the competent courts of Tours, France will have jurisdiction.
Pursuant to article L.612-1 of the French Consumer Code, the user may freely use a consumer mediator to amicably resolve any dispute.
